CASE REPORT CASE SUMMARY
DETAILS A. Predication: This case was predicated upon information that some individuals had placed platforms in trees in the Squaw Three Timber Sale and had placed debris on a Forest Service development road in the sale area, Sweet Home Ranger District, Willamette National Forest, Oregon. B. Referrals: To Linn County Sheriff's Office for assistance and because of the interests of a private party, Willamette Industries, the purchaser of the timber sale. C. Subject Descriptive Data: Ronald Calvin Huber; 824 SW 10th, Corvallis, Oregon, or 2800 Cheverly Avenue, Cheverly, Maryland; d.o.b. 03/24/55; W; M; 5'11" 150 lbs; Brn; Brn; MD dl 5411385; Telephone: (503)754-9151. Violation(s) Described:Entering an area closed by a Special Order (36 CFR 261.53 [e] and [f]) and damaging a tree (36 CFR 261.6 [a]); 16 USC551; also State charges of Criminal Trespass II:, Resisting Arrest, and Recklessly Endangering the Life of a Person. Sequence of Events: On June 27, 1985, Special Agent Carla Jones and I observed five platforms capable of holding a person suspended by ropes from branches of trees in the Squaw Three Timber Sale. Two were in Unit 9 and three were in Unit 6. Three were occupied by unknown persons. Banners were hanging from the trees; some bearing the name Earth First! Steel bolts or nails were driven in the tree trunks, leading from the ground to the platforms. =============================================== Squaw Three Trespass Page Two E.Sequence of Events: (cont) 2. On July 1, 1983, Willamette Industries crews began doing road work on Forest Road 2046000 and 2046505, which leads into the sale area. Closure notices were posted by Carla Jones and me that day. Four persons were in the area and on the road. They had placed some small logs on the road and had planted some small hemlock, cedar, and alder trees in the roadway. I advised them of the closure and requested that they leave the roadway. They complied with my request to leave and also removed the trees. 3. On July 4, 1985, Linn County Deputy Sheriff arrested the following for criminal trespass II in Squaw Three closed area: o Steven Paul Osterhout; 637 SW 6th; Corvallis, Oregon; 03/27/56.

5. On July 10, 1985, Carla Jones, Richard Olsen (Law Enforcement Officer, Santiam Engineering Zone), and I observed . Ronald Calvin Huber in a platform in a tree in the closed portion of the Squaw Three Timber Sale. He was ordered to leave. Willamette Industries crews began falling the remaining standing timber in Unit 6. Two other trees that had abandoned platforms in them were felled and the platform were taken in custody of the Linn County Sheriff's Office. Both of the trees had bolts in them that set at intervals of approximately every 5 feet from the ground to the platforms, approximately 75 feet up the trees. Timber falling, except for the occupied tree and a nearby tree, was completed on July 12. On July 12, 1985, a female using the name of Rhody Dendron was observed in the tree by Carla Jones. She is believed to be Valerie Wade, per an article in The Oregonian newspaper. On July 12, 1985, Michael James Jakubal was again arrested by Linn County Deputy Chris Ives for criminal trespass 11 in the Squaw Three closure. ------------------------------------------------------------ Squaw Three Trespass
E. Sequence of Events: (cont) 7. On July 19, 1985, George Cummins Crane; 546 Higuera, #14; San Luis Obispo, California; Telephone: (503) 754-9151, was observed in a tree by Carla Jones and Chris Ives, Linn County Sheriff's Officer. On that day a claim was made that a logger working on the sale had attempted to strike, with a log,the tree that was occupied by Crane. The claim was investigated by the Linn County Sheriffs Office. Also Richard Lon Mulvaney; Box 1307; Redway, California; 07/22/47 and Mary Beth Nearing; 824 SW 10th; Corvallis, Oregon; 12/05/60, were camped immediately next to the closure. The area around the unit had been used for camping by Earth First! members, continuously, since July 1, 1985. The yarding and hauling of the timber was scheduled to begin on Monday, weather permitting. Willamette Industries personnel did not believe that the unit could be safely logged with the occupied tree still standing; especially because it was occupied by a person. On July 20, 1985, I observed Ronald Calvin Huber in the platform, 80 feet above ground in the tree in the closed area. I told him to cone down. He refused. An 130 foot crane with a man-bucket was moved next to the tree and Linn County Deputies Chris Ives and David Freeman went up in the man-bucket and arrested Huber for criminal trespass II, resisting arrest, and recklessly endangering. I removed his personal belongings from the platform and from around the platform in the tree and secured them at the Sweet Rome Ranger Station. On July 21, 1985, Richard Olsen observed a wrench, hammer, spikes, and lag screws in Huber's possesions. On July 22, 1985, Olsen observed 40 spikes and screws in the tree that had been occupied by Huber. 10. On August 8, 1985, John Davis, Willamette Industries, Albany, Oregon advised Mike Kerriek, Forest Supervisor, Willamette National Forest, that they were unable to remove many of the bolts from the trees in Unit 6; thus making them unuseable and therefore unsaleable. ---------------------------------------------------------------- STATEMENT OF RICHARD OLSEN On 7/10/85, I and Carla Jones arrived at the Squaw 3 Timber Sale, Unit 06, at approximately 6:00 a.m. I saw a person sitting on a platform which hung from a branch of a large Douglas Fir tree. The platform was approximately 80' above ground level. Using binoculars I recognized the person as Ronald Calvin Huber. I observed that spikes and lag bolts had been driven into the tree. They formed a straight line running up the tree to the platform, spaced about 5' apart. We left the area sometime around 2:00 p.m. On 7/20/85, Jim Christensen and I arrived at Unit # 6 at 11:30 a.m. I again observed Ron Huber in the same position in the same tree. Later that same day (approximately 6 p.m.) we returned to the site and I again observed Ron Huber in the same tree. Using binoculars I saw Huber unscrew a lag bolt using a socket wrench. I took photographs of the arrest and removal of Huber from his perch. I saw Jim Christensen retrieve Huber's property from the perch. Christensen and I transported the property to Sweet Home Ranger Station where we secured it in a locked warehouse at approximately 11:00 p.m. On 7/21/85, at approximately 2:00 p.m. at Sweet Home Ranger Station, I inventoried Huber's property seized on 7/20/85. I observed one 3/8-inch socket wrench, one 16 oz. claw hammer, 3 8-inch spikes, 6 6-inch lag screws, and a diary with Ron Huber's name and address on the inside cover. I transferred the property to a locked property locker. On 7/22/85, Dale Wilson and I briefly visited Unit # 6. I observed the perch tree, which was now on the ground, in which I counted 40 spikes and lag screws of the same type and diameter as I had observed in Huber's property on 7/21/85.
