RE: Dragon Products Thomaston, Solid Waste Facility License Applications Dear Mr. Huber: Thank you for your letter of August 9, 2005 requesting that the Board of Environmental Protection assume jurisdiction over applications by Dragon Products Company for solid waste facility licenses for its Thomaston facility. Under provisions of Chapter 2 section 17A of the Department's Rules Concerning the Processing of Applications, the deadline for requests for Board jurisdiction is no later than 20 days after the application is accepted as complete for processing. In this instance, the applications in question have been pending since 1991, and the deadline for requests for Board jurisdiction has passed. However, as you noted, the Board has the authority to assume jurisdiction of any application on its own initiative if it finds that one or more of the criteria set forth in statute and rule are met. In response to your letter, Board Chairman Scott has requested that the Board be briefed on the status of the solid waste facility applications. This staff briefing is scheduled for the September 22, 2005 Board meeting. Members of the public and representatives of the company may attend the September 22°a briefing; however, Chairman Scott has determined that the Board will not hear arguments from the parties at that time. If, following the staff briefing, the Board wishes to consider assuming jurisdiction over the applications on its own initiative, the Board may schedule time at a subsequent meeting to hear arguments regarding whether the criteria for Board jurisdiction are met. The Board's September 22, 2005 meeting will be held at the Holiday Inn / Ground Round, Civic Center Drive in Augusta beginning at 9:00 am. I anticipate the briefing on Dragon Products' Thomaston facility will begin at approximately 1:00 pm. A copy of the Board's agenda for September 22nd is enclosed.
