Like we discuss I would send this to Kaitlyn and request to either speak with her concerning EFH conservation recommendations #2 and/or request for her to remove the recommendation when reevaluating the new plans. Implementing the recommendation would set a precedent by requiring mitigation for placing new riprap on existing riprap with no increase in impacts. The Corps is not willing to set that precedent. The impact of 321 SF of fill on existing riprap is not a permanent conversion of intertidal habitat to revetment but rather maintenance of existing rip rap, which the plans clearly identify. Additionally the impacts are above MHW which is not EFH according to Appendix A: EFH designation methodologies of The New England Fishery Management Council OMNIBUS ESSENTIAL FISH HABITAT AMENDMENT 2 FINAL ENVIRONMENTAL IMPACT STATEMENT if life stages of species is “known to utilize intertidal habitats, the minimum depth of EFH was defined as 0 meters relative to the mean high water (MHW) datum and an explicit reference to the intertidal zone was made in the description. (pg. 26). If NMFS choose not to either route, then we will proceed more formal, which I have done one.
