Federal Interagency Comment Form Date: 10/22/21 Project: Yachting Solutions Boat Basin Appl No.: FY19AP00378 Commenting Agency: NOAA/NMFS/GARFO/HCD Action Agency Project Manager: Bill Perry, USFWS Waterway: Rockland Harbor Activity: The proposed project will dredge 12,520 cubic yards of material from a 3.2 acre area to between -6ft and - 13ft relative to MLW, install 2,625 linear feet of new floating docks, design outer dock as a wave attenuator, install new gangway access platform and a 80' x 4' aluminum gangway which meets ADA requirements. Dredged material will be beneficially reused off-site for gravel pit reclamation. ESSENTIAL FISH HABITAT (EFH) Project may adversely affect EFH. The area has been identified as EFH for 20 federally-managed species including, but not limited to, winter flounder, Atlantic cod, pollock, ocean pout, silver hake, red hake, white hake, windowpane flounder, smooth skate, little skate, winter skate, thorny skate, and Atlantic sea scallop. ESSENTIAL FISH HABITAT CONSERVATION RECOMMENDATIONS: (Note: EFH CRs require a response from the federal action agency within 30 days of receipt or 10 days before a permit is issued if CRs are not included as a special condition of the permit. In addition, a distinct and further EFH consultation must be reinitiated pursuant to 50 CFR 600.920 (j) if new information becomes available, or if the project is revised in such a manner that affects the basis for the above EFH determination or EFH conservation recommendations.) 1. No dredging should occur from March 15 to June 30, of any calendar year, to protect sensitive life history stage winter flounder EFH. 2. Compensatory mitigation should be provided for the permanent conversion of 321 square feet of intertidal habitat to revetment. FISH AND WILDLIFE COORDINATION ACT COMMENTS ENDANGERED SPECIES Threatened or endangered species under the jurisdiction of NMFS may be present in the project area. The federal action agency will be responsible for determining whether the proposed action may affect listed species.
