Transfer of Administration of Sears Island from Maine Department of Transportation to the Maine Department of Conservation. Whereas, Sears Island in Penobscot Bay is Maine's largest unprotected publicly-owned island; and Whereas, the island and its surrounding waters possess important ecological, recreational and economic values in its current natural state; and Whereas, Sears Island is presently administered by the Maine Department of Transportation within its Ports and Marine Enterprise Fund, and Whereas the Maine Department of Transportation lacks the mandate to manage the island for those ecological, recreational and economic values; and Whereas, the Bureau of Parks and Lands of the Maine Department of Conservation has a variety of programs under which Sears Island can be managed for those ecological, recreational and economic values; and Whereas, statutory mechanisms exist for transferring administration of state public lands between these two agencies; Be it : Section 1. Transfer. Resolved: Pursuant to 12 MRSA §1815, 23 MRSA § 61 and 23 MRSA § 4424, ownership, management and administration of Sears Island in Searsport, Maine is transferred from the Maine Department of Transportation's Ports and Marine Enterprise Fund to the Maine Department of Conservation's Bureau of Parks and Lands. ---------------------------------------------- END OF DRAFT BILL
